PRIVACY POLICY

Please read this Privacy Policy carefully as it forms part of the Terms and Conditions of Use (the “Terms”)  between you and ArchRealtors.com (hereinafter referred to as “we”, “us”, or “our”), and, together with the Terms into which this Privacy Policy has been incorporated, will govern your use of and access to the ArchRealtors.com website (the “Site”) and all materials, information, data, text, software, music, sound, photographs, graphics, video, messages, communications or other resources and content available on or at the Site (collectively, “Content”).

By using or accessing the Site or any Content, you accept and agree to be bound by this Privacy Policy.  You may use or access the Site and the Content only in compliance with this Privacy Policy and only if you have the legal power to form a contract with us and are not barred under any applicable laws from doing so.  IF YOU DO NOT ACCEPT AND AGREE TO BE BOUND BY THIS PRIVACY POLICY, YOU MAY NOT ACCESS OR USE THE SITE OR ANY CONTENT.

We reserve the right, in our sole discretion, to modify, add, or remove any of the terms of this Privacy Policy without additional notice to you.  Any changes will be effective upon posting the revised Privacy Policy at the Site (or such later effective date as may be indicated at the top of the revised Privacy Policy). You are encouraged to review this Privacy Policy prior to each use of the Site for any changes.  Your continued access to and use of the Site constitute your acceptance of such changes.

Information You Provide To Us

We collect information about you when you inquire about our services or products or the services or products offered by any Third-Party Providers (as defined in the Terms) or submit any request to us in connection with such services or products, participate in other features available at or through the Site, or otherwise communicate or interact with us. This information, which is generally referred to as “Personal Information,” is intended to uniquely identify you and typically includes your name, email address, phone number and mailing address, and other personal information that might enable us or Third-Party Providers to contact you in accordance with the Terms. We may combine supplemental information we collect about you with Personal Information about you collected at or through the Site and we will treat the combined information as Personal Information.

The Site may contain bulletin board services, news groups, forums, blogs and/or other message and communication facilities (“Communication Services”) designed to enable you to communicate with others at or through the Site.  Please remember that any information that you disclose in the Communication Services areas may be or become public information and may not be subject to the provisions of this Privacy Policy. Accordingly, you should exercise caution when deciding to disclose Personal Information in Communication Services areas.

Information We Collect Automatically

Whenever you use or access the Site, we and/or our service providers may use a variety of technologies that automatically or passively track or collect information about how you use Site and the Content (“Usage Data”). Usage Data may include, but not be limited to, browser type, device type, operating system, the page served, the time, the preceding page views, and your use of features or applications on the Site and/or the Content, as well as email deliveries, email opens and email click-throughs. This statistical data provides us with information about the use of the Site and the Content, such as how many visitors visit a specific page on the Site, how long they stay on that page, and which hyperlinks, if any, they “click” on. This information helps us optimize the design and operation of the Site to best suit the needs and interests of our visitors.  We may associate Usage Data with you as a specific and identifiable person and will treat that as Personal Information.

We may also automatically collect your IP address or other unique identifier (“Device Identifier”) for the computer, mobile device, technology or other device (collectively, “Device”) you use to access the Site.  A Device Identifier is a number that is automatically assigned to your Device when you access a Site or its servers, and our computers identify your Device by its Device Identifier. We may use a Device Identifier to, among other things, administer the Site and the Content, help diagnose problems with our servers, analyze trends, track users’ web page movements, help identify you, and gather broad demographic information for aggregate use. The technologies used on the Site to collect Usage Data, including Device Identifiers, include but are not limited to:

Cookies. Cookies are data files placed on a Device when it is used to visit the Site.  We and our Third-Party Providers may place cookies or similar files on your Device for security purposes, to facilitate Site navigation without having to continually re-enter your information and/or to customize and enhance your experience while visiting the Site and/or using the Content. Cookies allow us to collect technical and navigational information, such as browser type, time spent on the Site and pages visited. Cookies allow us to select which of our features, products and services or those offered by our Third-Party Providers are most likely to appeal to you and display them while you are on Site. If you would prefer not to accept cookies, you can change your browser settings to notify you when you receive a cookie, which lets you choose whether or not to accept it; or set your browser to automatically not accept any cookies. However, in such event the offers we provide when you visit our Site may not be as relevant to you or tailored to your interests.

Pixel tags. A pixel tag is a transparent graphic image (sometimes called a clear GIP, transparent GIF, web bug, web beacon or tracking beacon) placed on a web page or in an email, which indicates that a page or email has been viewed. In addition, a pixel tag may tell your browser to get content from another server. The pixel tags on the Site are set only by companies we work with and supervise.

Email Data. We may track email that you open and links that you click within emails you receive from us.

Third Party Clickstream Data.  Clicking on links available at the Site may redirect you to other Sites not owned by us, including through Linked Sites (as defined in the Terms).  In any such event, those third parties may place cookies or clear GIFs on your Device.  This Privacy Policy does not govern the use and disclosure of any information collected by third parties, such as through cookies or clear GIFs, when you visit their Sites or by third parties regarding your clickstream activity on Sites other than the Site.

Information We Receive From Others

We may receive information about you from third parties.  For example, if you are on another website and you opt-in to receive information from us, that website may submit to us your email address and other information about you so that we may contact you as requested. You may also choose to participate in a third-party application or feature (such as one of our Facebook or Twitter applications or a similar application or feature on a third-party website) through which you allow us to collect (or the third party to share) information about you, including Personal Information such as lists of your friends, “likes”, comments you have shared, groups and location. In addition, we may receive information about you if other users of a third-party website give us access to their profiles and you are one of their “connections” or information about you is otherwise accessible through your “connections’” web page, profile page, or similar page on a social networking or other third-party website or interactive service.

We may also supplement the information we collect about you through the Site with outside records from third parties in order to enhance our ability to serve you, to tailor the Content to you and to offer you products or services that we believe may be of interest to you. We may combine the information we receive from these third parties with information we collect through the Site. In those cases, we will apply this Privacy Statement to any Personal Information received, unless we have disclosed otherwise.

  1. How We Use the Information We Collect

We may share your Personal Information and Usage Data with third parties.  Where we do share such information and data, use of that information is strictly limited to the following:

Third-Party Providers (as defined in the Terms):  We work with Third-Party Providers and others who help support our business, make various features, services and materials available to you on the Site and/or respond to your inquiries.  We may share your Personal Information and Usage Data with these providers. These providers will only be allowed to use your Personal Information and Usage Data for the purpose of providing the specific services or products requested by us or by you.  We require our service providers to undertake to maintain the confidentiality of your Personal Information and Usage Data in accordance with this Privacy Policy. This prohibition does not include or cover links to third-party sites accessible on the Site.

Advertising Partners:       Advertising partners help us to deliver targeted, personalized content to you through our Site. The use of advertising partners may involve the sharing of certain information about you. This information is shared to enable us and our advertising partners to understand your interests and preferences, and to deliver advertisements that are the most relevant to you.

Law Enforcement Agencies:  In certain circumstances, we may be obligated to share information about you with law enforcement agencies, regulators, and other government authorities when we have a good faith belief that it is necessary to do so to comply with the law (both within and outside the United States). We may also share information about you with these entities when we believe it is necessary to detect, prevent and address fraud, the unauthorized use of our products and services, violations of our terms of use or other policies, and other harmful or illegal activity; or when it is necessary to protect ourselves, you or others (including as part of an investigation or regulatory inquiry), or to prevent death or imminent bodily harm.

Affiliated Businesses:  We may share your Personal Information and Usage Data with other companies affiliated with or commonly controlled by us.  We may also share or disclose information about you to third parties as part of any merger, acquisition, sale, or financing agreement. In such cases, we will continue to protect personal information in our possession in accordance with this Privacy Policy and will provide notice before any personal information is transferred to the new owner or custodian or becomes subject to a different privacy policy.

  1. Retention and Protection of Personal Information

Protecting the confidentiality of any Personal Information we have collected about you is of utmost importance to us. We retain your Personal Information for only as long as necessary to satisfy legitimate and essential business purposes such as maintaining the performance and availability of our Site, Content and services, complying with legal obligations, and resolving any disputes.

We also implement and maintain appropriate technical and operational controls (including encryption and access control measures) to protect your Personal Information while it is stored on our systems. With that said, please note that no system or data transmission is ever completely secure. While we make all reasonable efforts to protect the confidentiality of the Personal Information we collect about you, we make no guarantees, representations, or warranties with respect to the security of your personal information during storage or transmission.

Most of the information we collect about you is associated with your user account. To help protect your account, we encourage you to use a strong password that is unique to your use of the Site, never share your password with anyone, never store your password in an insecure location or manner, and logout of your account when you are finished using the Site. If you suspect that your password may have been compromised or that your account has been used in an unauthorized manner, we recommend you change your account password immediately.   1. Requesting Deletion of Your Personal Information

At your request, we will delete (or anonymize) any Personal Information we have collected about you over the previous 12 months. Please understand, though, that we will not (nor are we legally obligated to) respond to more than two such requests within a 12-month period. We may also be legally required or allowed to retain your Personal Information in certain circumstances even when you’ve requested that we delete such information, including:

  • Where there is an unresolved issue relating to your account such as an outstanding credit, unpaid balance, or unresolved dispute.
  • Where we need to retain your Personal Information for our legal, tax, audit and accounting obligations as required by applicable law.
  • Where it is necessary to maintain your Personal Information for our legitimate business interests such as fraud prevention or to maintain the security of the Site.

  1. Notice to California Residents

If you are a California resident, then the collection, processing and use of your Personal Information may be subject to the California Consumer Privacy Act (“CCPA”) as well as other applicable California state privacy laws.  As a company that does business in California and collects the Personal Information of some California residents, we are required to inform you of the consumer rights afforded to you under the CCPA, and to enable you to exercise those rights with regards to any Personal Information that we may have collected about you.

As a California resident, you have the right, under the CCPA, to request information about the collection, use, and disclosure of your Personal Information over the previous 12 months, including:

  • the categories and specific pieces of Personal Information about you that have been collected;
  • the purposes for which your Personal Information have been collected, used or sold (where applicable);
  • the categories of third parties with whom your Personal Information have been disclosed;
  • the categories of Personal Information about you that have been disclosed for a business purpose; and where applicable and
  • the categories of Personal Information about you sold to third parties; the categories of third parties to whom your Personal Information was sold; and the categories of Personal Information about you for each third party to whom your Personal Information was sold.

You also have the right under the CCPA to do the following:

  • To request the deletion of any Personal Information that has been collected about you over the prior 12 months, subject to certain exceptions. Please refer to “Requesting Deletion of Your Personal Information” section for more information
  • To request that your Personal Information not be sold to any third parties. Businesses who sell the Personal Information of California residents are required to respect “opt out” requests for a period of at least 12 months before requesting your authorization to resume selling your Personal Information.
  • To not have to pay any fees, higher prices or rates for services, receive a lower level of service, or lose your services altogether for exercising your rights under the CCPA; understanding, however, that some Personal Information may need to be retained in order to continue to deliver those services to you.

Please note that the CCPA does not obligate us to provide the requested information to the same consumer more than twice in a 12-month period.

We have undertaken extensive steps to identify whether any of our data sharing arrangements would constitute the “sale” of Personal Information under the CCPA. We continue to maintain that we do not sell, trade, rent or otherwise disclose Personal Information to a third party for “monetary or other valuable consideration” and, therefore, are not required to provide you the ability to “opt out” of the sale of your Personal Information since we do not engage in such activities.

Our Site is not intended for use by children under 13 years of age. We would never knowingly collect personal information from or about children under the age of 13. If you are under 13 years of age, please do not use our Site or provide any of your personal information to us.
